Breakthrough Permit Resolution in Novato Offers a New Model for Marin County

Novato, CA — June 15, 2026 — A complex red-tagged property in Novato has successfully achieved FEMA compliance, removed a red tag, and avoided costly structural elevation or reconstruction, creating a potential model for resolving similar permit challenges for other Novato Homeowners.

The project was led by Clare Michael, who coordinated the effort to navigate regulatory requirements, technical challenges, and stakeholder alignment. Referred by Denise Athos, long-time realtor and Novato City Councilmember, Michael coordinated a successful outcome and restored momentum to the property while saving the homeowner tens of thousands of dollars in potential construction costs.

"This is more than a permit victory," said Michael. "It demonstrates that when the right expertise, persistence, and collaboration come together, even highly restrictive situations can be resolved.” Advised by Chief Building Department, Bob Curry and Novato Assistant Engineer Manijeh, and White & Prescott Land Engineers who understood the many changes to the flood control system made all the difference to the way FEMA viewed this property.

The resolution required careful coordination between engineering professionals, regulatory agencies, and specialized land and water flow analysis to satisfy FEMA flood zone requirements while preserving the existing structure.

Results achieved:

  • Red tag removed
  • FEMA compliance achieved
  • No structural elevation required
  • No rebuild required
  • Significant homeowner cost savings
Marin County's 13 building jurisdictions each operate with their own procedures and interpretations. This Novato success demonstrates how complex permit situations can be resolved through clear communication, practical problem solving, and coordinated expertise.

"When projects fall out of alignment with the system, progress stops," said Michael. "This case proves they can be brought back into compliance without extraordinary cost, further delay, or compromise."

For nearly three decades, Clare Michael has worked at the intersection of design, construction, and project coordination, helping homeowners, contractors, and regulatory agencies navigate complex residential challenges and restore momentum to projects at risk of stalling.
